Waste Removal Acton Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Acton provides waste collection and related services within the United Kingdom. By booking any service with us, you agree to be bound by these Terms and Conditions, which apply to all domestic and commercial customers unless agreed otherwise in writing.

1. Definitions

In these Terms and Conditions, the following definitions apply:

1.1 Service means any waste removal, rubbish collection, clearance, loading, transportation, recycling, disposal, or related service provided by Waste Removal Acton.

1.2 Customer means the individual, business, company, organisation, or other entity requesting or receiving the Service.

1.3 Agreement means the contract between Waste Removal Acton and the Customer comprising these Terms and Conditions and the confirmed booking details.

1.4 Waste means any items, materials, rubbish, furniture, appliances, green waste, construction debris, or other matter presented for collection by the Customer, excluding any prohibited or hazardous items.

1.5 Hazardous Waste means waste classified as hazardous under applicable UK laws and regulations, including but not limited to chemicals, solvents, asbestos, clinical waste, oils, paints, gas bottles, batteries, and electrical items requiring specialist treatment.

2. Scope of Services

2.1 Waste Removal Acton provides waste removal and collection services for households and businesses, including one-off clearances, scheduled collections, bulky item removal, and related clearance activities.

2.2 The specific scope of the Service, including the type and volume of waste to be removed, the collection location, timing, and any additional tasks such as loading or dismantling, will be confirmed at the time of booking.

2.3 We reserve the right to refuse to collect any items that we reasonably believe to be hazardous, illegal, unsafe to handle, or outside the scope agreed in the booking.

2.4 The Customer is responsible for ensuring that the Service requested is suitable for their needs and for providing accurate information when booking.

3. Booking Process

3.1 Bookings may be made by telephone or by other contact methods we make available from time to time. All bookings are subject to acceptance by Waste Removal Acton.

3.2 When making a booking, the Customer must provide accurate details of the collection address, access arrangements, type and approximate volume of waste, any parking restrictions, and any special circumstances or requirements.

3.3 We may request photographs or a detailed list of items to provide a more accurate estimate. Any estimate given prior to a site visit is indicative only and may be revised once our team attends the premises.

3.4 A booking is not confirmed until we have accepted it and provided the Customer with a confirmation of the Service details, including the scheduled date or time window and indicative charges where applicable.

3.5 Waste Removal Acton may decline a booking at its discretion, including where the requested Service is not available or the waste is unsuitable for our standard service.

4. Access and Service Delivery

4.1 The Customer must ensure that our team has safe, reasonable, and lawful access to the premises and waste to be collected at the agreed time.

4.2 The Customer must arrange any necessary permissions for parking, loading, or entering premises, including permits for restricted parking zones where required.

4.3 If our team is unable to access the premises or waste due to circumstances within the Customer's control, we may charge a call-out fee or a reasonable proportion of the Service charge.

4.4 While we will make reasonable efforts to attend within agreed time windows, all timings are estimates and may be affected by traffic, weather, operational, or safety considerations. We will not be liable for minor delays beyond our reasonable control.

4.5 The Customer, or an authorised representative, should be present at the premises during collection to confirm the waste to be taken and to approve any variations to the Service or price that may be required on the day.

5. Service Charges and Payment

5.1 Charges for the Service are normally based on factors such as the volume and weight of waste, type of waste, loading time, access conditions, and any additional labour or dismantling required.

5.2 Any price provided in advance of collection is an estimate only, based on the information supplied by the Customer. The final charge will be confirmed on site once our team has inspected the waste and access conditions.

5.3 We reserve the right to vary the quoted price where the actual waste volume, type, or access conditions differ materially from those described at the time of booking.

5.4 Unless otherwise agreed in writing, payment is due in full upon completion of the Service and prior to our team leaving the site.

5.5 We accept payment by the methods notified to the Customer at the time of booking. We do not accept payment by cheque unless expressly agreed.

5.6 For business customers with approved accounts, payment terms will be confirmed in writing. In the absence of other agreement, payment is due within 14 days of the invoice date.

5.7 We reserve the right to charge interest on overdue amounts at the statutory rate applicable to commercial debts, together with any reasonable costs of debt recovery.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by giving us notice by telephone or by another accepted communication method.

6.2 For standard bookings, cancellations notified more than 24 hours before the scheduled collection time will normally be accepted without charge.

6.3 Cancellations made less than 24 hours before the scheduled collection time may incur a cancellation fee or call-out charge to cover administrative and operational costs.

6.4 If the Customer is not present at the agreed time or fails to provide access, this may be treated as a late cancellation and a reasonable fee may apply.

6.5 Any request to amend the booking, including changes to the date, location, or estimated volume of waste, will be subject to our availability and may result in an adjustment to the price.

6.6 Waste Removal Acton reserves the right to cancel or reschedule a booking due to operational reasons, safety concerns, adverse weather, vehicle breakdown, or circumstances beyond our control. In such cases, we will offer a rebooking at the earliest reasonable opportunity.

7. Customer Responsibilities

7.1 The Customer is responsible for:

a. Providing accurate information when booking.

b. Ensuring safe and lawful access to the premises and waste.

c. Separating any hazardous or restricted items and notifying us in advance.

d. Ensuring that no prohibited materials are mixed with general waste.

e. Supervising children, pets, and other persons on the premises during collection.

7.2 The Customer must not request or permit our team to undertake any activity that is unsafe, illegal, or outside the agreed scope of the Service.

7.3 Any additional labour requested that falls outside the original agreement, such as dismantling structures or moving items from difficult access areas, may be refused or subject to additional charges.

8. Waste Types and Regulations

8.1 Waste Removal Acton operates in accordance with applicable UK waste management legislation and guidance, including the duty of care for controlled waste.

8.2 We hold or operate under the necessary registrations, licences, or exemptions for transporting and handling non-hazardous waste, as required by law.

8.3 We will dispose of collected waste only at authorised facilities such as licensed transfer stations, recycling centres, or disposal sites, in line with relevant regulations.

8.4 The Customer acknowledges that certain items are classified as hazardous or require specialist treatment and may not be accepted under our standard Service. These may include, without limitation, asbestos, chemicals, solvents, oils, fuel, gas cylinders, clinical waste, large batteries, and certain electrical equipment.

8.5 If hazardous or prohibited waste is discovered among the items presented for collection and was not disclosed in advance, we may refuse to remove it, charge additional fees for safe handling, or cancel the Service in whole or in part.

8.6 The Customer remains responsible for any breach of waste regulations arising from inaccurate descriptions of waste, failure to disclose hazardous materials, or any illegal items presented for collection.

9. Title and Risk

9.1 Title to waste passes to Waste Removal Acton once the items have been loaded onto our vehicle, provided that payment is made in accordance with these Terms and Conditions.

9.2 Until title passes, the waste remains the property and responsibility of the Customer.

9.3 Once waste has been collected and title has passed, the Customer has no further rights to the items and cannot request their return.

10. Liability and Limitations

10.1 Waste Removal Acton will exercise reasonable care and skill when providing the Service.

10.2 We shall not be liable for any pre-existing damage to property, fixtures, fittings, driveways, or access ways, or for wear and tear caused by normal usage of vehicles or equipment in the course of the Service.

10.3 The Customer is responsible for protecting surfaces, driveways, and items that may be vulnerable to damage from the movement of waste or equipment. If the Customer instructs us to place vehicles or equipment in an area not generally intended for such use, this is at the Customer's own risk.

10.4 To the fullest extent permitted by law, Waste Removal Acton shall not be liable for any loss of profits, business interruption, loss of data, or any indirect or consequential loss arising out of or in connection with the Service.

10.5 Our total liability for any claim arising from the Service, whether in contract, tort, or otherwise, shall be limited to the total charges paid or payable by the Customer for the specific Service giving rise to the claim.

10.6 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded under UK law.

11. Insurance

11.1 Waste Removal Acton maintains public liability insurance at a level considered appropriate for the nature of our Services.

11.2 Evidence of insurance can be provided to business customers on reasonable request.

12. Complaints and Service Issues

12.1 If the Customer has any concerns or complaints about the Service, they should contact us as soon as possible with details of the issue.

12.2 We will investigate complaints in a fair and timely manner and, where appropriate, may propose corrective actions, a re-visit, or a partial refund at our discretion.

12.3 Complaints relating to alleged damage or loss must be notified within a reasonable period after becoming aware of the issue, and in any event no later than 7 days after the Service, to allow proper investigation.

13. Data Protection and Privacy

13.1 Waste Removal Acton will handle any personal data provided by the Customer in accordance with applicable UK data protection laws.

13.2 Personal information may be used for booking administration, Service delivery, customer communication, and record-keeping. We may also use contact details to provide information about our services, subject to applicable consent requirements.

13.3 We will not sell personal data to third parties. Data may be shared with service providers or authorities where required for operational, legal, or safety reasons.

14. Force Majeure

14.1 Waste Removal Acton shall not be liable for any delay or failure to perform the Service due to circumstances beyond our reasonable control, including but not limited to extreme weather, accidents, strikes, lockouts, road closures, acts of God, or legal restrictions.

14.2 In such circumstances, we may suspend or reschedule the Service without liability, and will inform the Customer as soon as reasonably practicable.

15. Variations to Terms

15.1 Waste Removal Acton may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that Service.

15.2 Any variation to these Terms and Conditions proposed by the Customer shall be effective only if expressly agreed in writing by Waste Removal Acton.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, whether contractual or non-contractual.

17. Severability

17.1 If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable.

17.2 If such modification is not possible, the relevant provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

18.1 These Terms and Conditions, together with the booking confirmation and any written variations agreed by us, constitute the entire agreement between Waste Removal Acton and the Customer in relation to the Service.

18.2 The Customer acknowledges that they have not relied on any statement, promise, or representation not set out in these Terms and Conditions or confirmed in writing at the time of booking.
